GENERAL TERMS AND CONDITIONS OF TRAVEL

These General Terms and Conditions of Travel have been prepared in accordance with the provisions of Act V of 2013 on the Civil Code of Hungary, in particular Section 6:254 (1)–(5), Government Decree No. 472/2017 (XII. 28.) on Package Travel Contracts, and Government Decree No. 213/1996 (XII. 23.) on Tour Operator and Travel Intermediary Activities, together with the attached Annex(es), which form an integral part of these Terms and Conditions.

These Terms and Conditions constitute an agreement between:

The Tour Operator and the Traveller shall hereinafter collectively be referred to as the "Parties".

1.Conclusion of the Contract

1.1 For each travel package organised by BC Service and Consulting Kft., operating under the Hungary For You brand publishes a detailed travel packages (hereinafter referred to as the "Travel Information"), which includes, among other things, the duration of the trip, a description of the services provided, their quantity and quality, as well as all other relevant information. For personalized or individually requested travel arrangements, the details of the travel services are specified in the written confirmation issued by BC Service and Consulting Ltd. and in the annexes to this Agreement.

1.2 All information published on the Hungary For You website, online booking platform, booking confirmation, email correspondence, travel itinerary, individual offers and any other written communication provided by BC Service and Consulting Ltd. shall form an integral part of the travel contract. Where information published on the website is updated after a booking has been made, the Traveller shall be informed of any material changes without undue delay.

1.3 By confirming the booking, the Traveller acknowledges that they have read, understood and accepted these General Terms and Conditions, the Travel Information, the Privacy Policy, any insurance information provided, and all documents forming part of the travel contract. If the Traveller does not act in person (for example when submitting the booking or paying the deposit), they may be represented by an authorised representative or legal guardian. Where the acting person provides BC Service and Consulting Ltd. with a duly executed written power of attorney having full evidentiary value under Hungarian law, the represented person shall become the contracting Traveller. If no such authorisation is provided, the person acting on behalf of the Traveller shall assume all obligations arising from this Agreement. The person acting without proper authorisation shall be fully liable for any damages or costs incurred by BC Service and Consulting Ltd. as a result of such unauthorised representation. Where the travel services are booked by a third party for the benefit of the Traveller, BC Service and Consulting Ltd. shall not be obliged to verify whether that third party is legally authorised to represent the Traveller.

1.4 The travel contract between the Traveller and BC Service and Consulting Ltd. shall be concluded in accordance with the applicable legislation upon registration of the booking, payment of the required deposit, and acceptance of the travel contract. In the case of a legal entity, the contract shall be concluded upon receipt of a written travel order. If, due to limited availability or any other reason, BC Service and Consulting Ltd. accepts the booking only on a conditional basis, this shall be indicated on the booking confirmation. In such cases, the travel contract shall become effective only after the Travel Organiser has received written confirmation from its service provider or partner (such as a shipping company or other supplier). The Traveller shall be notified in writing once the booking has been confirmed. The Traveller acknowledges that the travel services may only be used once the package price has been paid in full and the payment has been received and verified in the Travel Organiser's bank account. If full payment is not received for any reason, BC Service and Consulting Ltd. reserves the right to refuse the provision of the booked services and shall bear no liability arising therefrom.

2. Services and Package Prices

2.1 The Traveller shall pay the package price in accordance with the payment terms specified during the booking process. Unless otherwise agreed in writing, full payment is required to confirm the booking. A booking shall become valid only after the full package price has been received by BC Service and Consulting Ltd. and a booking confirmation has been issued. Travel services may only be used after full payment has been received.

2.2 If the Traveller fails to comply with the applicable payment deadlines, BC Service and Consulting Ltd. shall be entitled to terminate the travel contract, allocate the reserved capacity to another traveller, or cancel the booked services without delay in order to avoid or minimise cancellation charges imposed by suppliers. In such cases, the Traveller shall reimburse BC Service and Consulting Ltd. for any costs incurred in accordance with these Terms and applicable legal provisions.

2.3 The package price includes only those services expressly listed in the booking confirmation. Depending on the selected package, these may include transportation, golf activities, equipment hire, wine tasting, sailing experiences, welcome packages or other services. Any service not expressly listed is excluded from the package price.

3. Changes to Services and Prices

3.1. BC Service and Consulting Ltd. reserves the right to increase the total participation fee payable under the travel contract in the cases permitted by applicable law, including but not limited to changes in transportation costs (including fuel costs) or changes in exchange rates affecting the costs of services purchased from its suppliers. However, no price increase may be applied within 20 days prior to the commencement of the trip. The Travel Organiser shall notify the Traveller in writing of the amount and reason for any price increase. Any increase shall be calculated by adding the full amount of the relevant cost increase to the total participation fee. If the increase exceeds 8% of the original participation fee, the Traveller shall have the right to withdraw from the contract free of charge or to accept the proposed changes, in which case the Parties shall amend the contract accordingly. The Traveller must notify the Travel Organiser of their decision in writing within three (3) working days of receiving the notification. BC Service and Consulting Ltd. reserves the right to replace individual services with equivalent alternatives where this becomes necessary due to operational, safety or weather-related reasons, provided that the overall value and quality of the package are not materially affected.

3.2. Certain activities offered by Hungary For You, including golf, sailing and other outdoor experiences, are weather dependent. If weather conditions make an activity unsafe or impossible to operate, BC Service and Consulting Ltd. reserves the right to modify the itinerary, postpone the activity, provide an equivalent alternative or, where appropriate, issue a partial refund for the affected service.

4. Traveller's Right of Cancellation and Amendments

4.1 The Traveller may transfer their rights under the travel contract to another person who satisfies all conditions applicable to participation in the booked travel services.

The Traveller shall notify BC Service and Consulting Ltd. of such transfer in writing without undue delay. The transfer shall only become effective if the new traveller accepts all outstanding obligations arising from the travel contract and reimburses any reasonable administrative costs incurred by the Travel Organiser in connection with the transfer.

4.2 If, at the Traveller's request, an administrative amendment to the travel contract becomes necessary (for example, the correction of a name or other non-essential information), or if the Parties agree to amend a non-essential term of the Agreement, the Traveller shall reimburse BC Service and Consulting Ltd. for any reasonable costs arising from such amendment. The applicable amendment fee shall be communicated by the Travel Organiser. Changes to essential elements of the travel contract (including, but not limited to, the destination, travel dates or principal travel services) may only be made by cancelling the original booking in accordance with the cancellation provisions set out in Section 4.5, followed by the submission of a new booking.

4.3 BC Service and Consulting Ltd. reserves the right to modify or substitute any programme or service published in its Travel Information. The Traveller shall be notified of any such changes in writing without undue delay. If the Traveller accepts the proposed changes in writing, such changes shall become an integral part of the travel contract. If the Traveller does not respond within three (3) days of receiving the notification, BC Service and Consulting Ltd. shall be entitled to take the necessary measures to minimise any costs arising from the delay. The Travel Organiser shall not be liable for any loss or damage resulting from such measures.

4.4 The Traveller may withdraw from the travel contract at any time before the commencement of the trip. Any notice of cancellation must be submitted to the Travel Organiser in writing, with reference to the relevant booking. The cancellation shall become effective upon receipt by the Travel Organiser. Failure by the Traveller to commence the trip without prior written notice shall also be deemed to constitute cancellation, in which case the scheduled departure date shall be regarded as the date of cancellation. If the Traveller withdraws from the contract for reasons other than those specified in Section 3.1, cancellation charges shall apply as follows:

  • 14 to 7 days before departure: 50% of the total participation fee.
  • Within 7 days before departure, on the day of departure, or in the event of a no-show: 100% of the total participation fee.

Cancellation requests must be submitted by email to the address provided in the booking confirmation.

4.5. If the Traveller fails to arrive at the agreed meeting point at the scheduled time without prior notice, BC Service and Consulting Ltd. reserves the right to treat the booking as a no-show. In such cases, no refund shall be due unless otherwise required by applicable law.

5. Traveller Responsibilities

5.1 The Traveller is responsible for ensuring that they are physically and medically fit to participate in the booked activities. The Traveller agrees to follow all safety instructions provided by BC Service and Consulting Ltd., its representatives, instructors, partners and service providers throughout the duration of the experience. The Traveller is expected to arrive at the agreed meeting point at the specified time. Delays may result in reduced services or cancellation without refund where the delay is attributable to the Traveller. The Traveller shall respect the environment and keep all venues, vehicles and vessels clean. Any waste generated during the experience, including during sailing activities, must be disposed of in the designated bins or taken away by the Traveller.

6. Participation in Activities

6.1. The Traveller acknowledges that participation in golf, sailing, wine tasting and other outdoor or leisure activities is voluntary and undertaken at their own risk. The Traveller confirms that they are physically and medically fit to participate in the booked activities.

6.2. The Traveller agrees to follow all instructions provided by BC Service and Consulting Ltd., its representatives and service providers throughout the experience. During sailing experiences, the Traveller must comply with all instructions given by the captain. The captain's decision regarding safety and navigation shall be final.

6.3. The Traveller shall respect the rules of all venues, including golf clubs, wineries, marinas and other partner facilities. The Traveller shall use all equipment with reasonable care and shall be liable for any damage caused intentionally or through negligence.

6.4. Alcoholic beverages served during wine tasting experiences are available only to Travellers who have reached the legal drinking age under Hungarian law. BC Service and Consulting Ltd. promotes responsible alcohol consumption and reserves the right to refuse the service of alcoholic beverages where appropriate.

7. Cancellation by BC Service and Consulting Kft.

7.1 BC Service and Consulting Ltd. may cancel the travel contract by written notice no later than seven (7) days before the commencement of the trip if unforeseen and unavoidable circumstances arising after the conclusion of the contract endanger human life, health or property, or if the minimum number of participants required for the trip is not reached.

In such cases, the Traveller may choose either:

  • a full refund of all payments made; or
  • a substitute travel service of comparable quality and value, where available.

If the substitute service is of a higher value, the Traveller shall pay the price difference. If it is of a lower value, BC Service and Consulting Ltd. shall refund the difference.

7.2 BC Service and Consulting Ltd. shall not be liable for the cancellation or partial performance of the travel services where such cancellation or interruption results from force majeure or other extraordinary circumstances beyond its reasonable control, including but not limited to strikes, war, natural disasters or severe weather conditions. In such circumstances, the Travel Organiser shall provide reasonable assistance to the Traveller to the maximum extent possible, at the Traveller's expense where applicable.

8. Improper Performance of the Contract

8.1 If the travel services are not performed in accordance with the travel contract, the Traveller must report any complaint immediately to the tour guide or, where no tour guide is present, directly to the relevant service provider. The Traveller must request that a written report of the complaint be prepared and signed by the authorised representative of the service provider. If the complaint cannot be satisfactorily resolved on site (for example, if the service provider refuses to acknowledge the complaint or declines to prepare a written report), the Traveller must immediately notify BC Service and Consulting Ltd. using the emergency contact details provided in the travel documents or pre-departure information.

Prompt notification is a prerequisite for any subsequent claim for compensation. Failure to report the complaint in accordance with these provisions may affect the Traveller's ability to pursue such claims. Following the completion of the trip, any claim arising from improper or incomplete performance must be submitted in writing, together with the relevant complaint report, without undue delay and no later than five (5) days after the Traveller's return. BC Service and Consulting Ltd. shall respond to all complaints in accordance with the applicable legislation within a maximum of 30 days.

8.2 BC Service and Consulting Ltd. shall compensate the Traveller for any damage caused during the performance of the travel contract unless it proves that it acted with the level of care reasonably expected under the circumstances.

The liability of both the Travel Organiser and the Traveller shall otherwise be governed by the provisions of Government Decree No. 472/2017 (XII. 28.) and the Hungarian Civil Code. The Travel Organiser's liability for damages shall in any event be limited to twice the amount of the total participation fee, except where mandatory legal provisions provide otherwise.

9. Traveller's Responsibilities

9.1 The Traveller shall be solely responsible for complying with all passport, visa, customs, foreign exchange and public health regulations applicable to the trip.

BC Service and Consulting Ltd. shall inform the Traveller of the relevant requirements at the time the contract is concluded and shall draw attention to the possibility that such requirements may change. If the Traveller is unable to participate in the trip due to failure to comply with these requirements, they shall not be entitled to any compensation and their absence shall be treated as a cancellation by the Traveller in accordance with these Terms and Conditions.

10. Insurance

10.1 The participation fee does not include accident insurance, medical insurance, sports insurance or trip cancellation insurance. Accident, medical and sports insurance may be purchased separately at an additional cost. Trip cancellation insurance is optional and may be arranged individually.

10.2 BC Service and Consulting Ltd. has concluded the mandatory insolvency insurance required by Hungarian law with Alfa Vienna Insurance Group Insurance Company Ltd. Registered Office: 1091 Budapest, Üllői út 1., Hungary.

11. Other

11.1 BC Service and Consulting Ltd. may offer any remaining places on a trip at discounted Last Minute prices prior to departure. In such cases, Travellers who have previously purchased the same travel services at the standard price shall not be entitled to any refund or price adjustment. Discounts introduced after a booking has been confirmed shall not apply retrospectively.

11.2 Different discounts and promotional offers published by BC Service and Consulting Ltd. may not be combined unless expressly stated otherwise.

11.3 Due to long travel distances and unforeseen circumstances beyond the Travel Organiser's control (including, but not limited to, motorway accidents, vehicle breakdowns or other operational reasons), the planned transfer schedule, route or vehicle type may be changed where necessary.

11.4 The Traveller shall be solely responsible for the supervision and safekeeping of their luggage and personal belongings throughout the trip.

11.5 BC Service and Consulting Ltd. shall not be liable for changes to the natural environment affecting the travel services that result from extraordinary circumstances beyond its control (for example, wildfires or other natural events).

11.6 No later than five (5) days before the commencement of the trip, BC Service and Consulting Ltd. shall provide the Traveller in writing with the name, address and telephone number of its local representative or partner. Where no local representative is appointed, the Traveller shall instead be provided with an emergency contact number or other contact details enabling them to communicate directly with the Travel Organiser throughout the trip. If the period between the conclusion of the travel contract and the departure date is shorter than five days, the relevant information shall be provided separately before departure.

12. Settlement of Disputes

12.1 The Traveller shall be solely liable for any damage caused to third parties during the trip.

12.2 The Parties shall endeavour to resolve any dispute arising from this Agreement through mutual negotiations. Should no amicable settlement be reached, the dispute shall be subject to the exclusive jurisdiction of the competent courts of Hungary, in accordance with the applicable Hungarian legislation.

Declaration

I hereby declare that I have read, understood and accepted the terms and conditions of this Travel Agreement. By signing below, I acknowledge that these Terms and Conditions shall be binding upon me and, where applicable, upon my fellow travellers.
